Critical timing reminder Apply for your §16b extension at least 6–8 weeks before your current permit expires. In Berlin, LEA Abteilung E (for student permits) handles these — and appointment slots fill up fast. Applying online via the LEA portal secures your legal status while you wait.

The §16b Aufenthaltserlaubnis is the residence permit for non-EU students enrolled in a recognised German university or Fachhochschule. Every semester or two, you need to extend it — and the process at Berlin's Landesamt für Einwanderung (LEA) can feel opaque if you don't know what to expect.

This guide is based on direct experience with the Berlin LEA process. It covers what documents you actually need, what to watch out for, and how to handle the appointment.

Who Needs to Extend a §16b Permit?

If you are a non-EU international student enrolled at a German university and your current residence permit is expiring, you need to extend it. This applies whether you are at a public Fachhochschule, a university, or a private institution — as long as it is state-recognised (staatlich anerkannt).

Important: Check which LEA department handles your case Berlin's LEA has multiple departments. Student permits (§16b) are handled by Abteilung E — not Abteilung B, which handles other categories. If your previous application was routed to the wrong department, you may not have an active extension application on file. Check this before assuming your application is being processed.

The Core Documents — What LEA Actually Requires

Mandatory documents for §16b extension (Berlin LEA)

The LEA may also ask for a Studienfortschrittsbescheinigung (proof of academic progress) or a Studienprognose (study prognosis letter from your university). These are not always required upfront — in many cases, the LEA raises these at the in-person appointment rather than as mandatory upload items.

How to Apply: The Online Process

Since 2022, Berlin LEA requires most applicants to submit an initial online application before the in-person appointment. Here's how it works:

  1. Go to the LEA online portal (lea.berlin.de) and select "Verlängerung Aufenthaltserlaubnis zu Studienzwecken"
  2. Fill in the form and upload your mandatory documents
  3. Submit — you will receive a confirmation email. This submission legally secures your right to remain in Germany while the application is processed, even if your current permit expires in the meantime (this is called the Fiktionsbescheinigung effect)
  4. An appointment will be scheduled — either automatically or you'll receive instructions to book one
Submit before your permit expires The Fiktionsbescheinigung (legal fiction of continued validity) only applies if you submit your application before your current permit expires. Once the permit has expired, you are in an irregular situation, which complicates everything. Submit early.

The LEA Appointment: What to Expect

The in-person LEA appointment is where the caseworker reviews your documents and makes a decision. Here is what typically happens:

What if you have 0 ECTS credits?

This is a common situation for students who are in their first or second semester, or who transferred between universities. Having 0 ECTS does not automatically mean rejection — but it does mean you need to demonstrate that you are actively studying. Bring your current timetable, exam registrations, and if possible, a brief letter from your academic supervisor or programme coordinator confirming you are in good standing.

Common Mistakes to Avoid

After the Appointment

If approved, you may receive a sticker in your passport directly, or a separate Aufenthaltstitel card by post. The extension is typically granted for 1–2 years depending on your remaining study duration. Keep a copy of everything submitted.
